  1. This is of incredible significance. The Shakopee Mdewakanton of Minnesota, "Better yet, for those who live and work on the reservation, that payment is free from state income taxes." We go to Court to stop the State of Oklahoma from taxing revenue on our Reservation and the Federal Court Judge takes our reservation away from us completely! How does this happen?

      The Osage government can't run a lemon aid stand; how on earth are they going to operate and entire area the size of Osage county?

    3. Actually, the border of the MINERAL reservation is that of a count in Oklahoma. The 10th District Court determined that the tribe's reservation had not been just diminished but had been disestablished by an Act of Congress in 1906. Therefore, there is no need to worry about the Osage Nation government running anything in the county. They wouldn't even have the right to a police force were it not for a cross-deputization agreement with Oklahoma.

    1. The most curious thing about all this is the remarks of Justice Samuel A. Alito Jr. who said that it was a little late to raise the idea that half of Oklahoma is an Indian reservation. It isn't Native Americans who need to raise the idea that Oklahoma is an Indian Reservation. It's the U.S. Congress who make that determination not the Tribal Nations themselves. If it requires language in writing to so disestablish a Native American reservation and it's just not there then the legal presumption is that the pertinent reservation/s in question haven't been disestablished all along. Is Alito alright? Barking dogs, my eye!

  24. I starting to think that something may be up and that it's not good. I've been to three different Catholic parishes in the last several weeks. All three Priests have plead and the operational word here is "plead" with us to pray for the United States. Say what you will about the Catholics good or bad, they have an astonishingly good connection on the ground to what is going on and where, worldwide. I don't know what's going on but it may be time to start paying more attention than usual.

There is nothing you won't do to fund a school that has no accreditation. For you out of county or even State Tribal members, you can forget about getting scholarships anymore. The Osage News lays the case out good about how much the scholarship program costs in comparison to the in county educational services. Shame on all of you

      Now you see the truth. As laid out by the 1906 act as amended there is no denying the truth. This Government is tearing it's TRUE colors. This is no accident and this is no coincidence.
      I suspect the closer we come together the closer we come to the truth of all matters in relation to our resources, it's our responsibility as a Sovereign people we decide. We have the power, because not one person has authority governed by this Doctrine gives any authority other than to protect the resources for the Osage people and this Government is doing the complete opposite. Read it and take it to lawyer if you do not believe in what I am saying. It is the ruling law that takes above our Constitution.
      The Government grew on the back of the M.E with our resources.
      Now there are those that say it isn't so, then I say prove it?
      When you build a foundation of cracks, the walls come crumbling down on those lies.

    It has come to our attention that a report has been prepared that lists a number of the items that the Office of Fiscal & Performance Review has uncovered in the years that it was an active oversight arm of the Osage Nation Congress. The Osage people should know why OFPR is important and why it must be put back on its feet to again be operable. God only knows what has gone on since Congresswoman Alice Goodfox took over and apparently did nothing with it but let it drop away after Kelly Corbin left as its former head official. I include the members of Congress who knew or should have known the law and followed it with regard to the OFPR and keeping it active. I actually believe this is more than unlawful, it’s unethical to have done what they’ve done or specifically what they haven’t done especially with regard to what is on the report and how valuable to the Congress the OFPR has been in the past as an investigative arm, whether or not the Congress has chosen to take action on the items on the list. The report has been sent to me with permission to publish it. It's a broad overview of what has been uncovered and it does not include names. In spite of this fact, I believe that it's important for those of us who care about the Osage Nation government to know what information has been provided over the years by the OFPR when it was up and running. I will be publishing the report list in segments rather than in document format.

    1. Time Line of Osage Nation Office of OFPR— Part 1

      2/2007 to 3/2008

      Office was established in Legislation, but not operational. The following cases were discovered and brought to the authorities’ attention:
      Director of several federal and tribal programs was embezzling funds for personal gain. Sentenced to federal time.

      Executive administrative assistant of a tribally funded program was found to be embezzling funds, thru fraudulent travel claims, obtaining refunds for building rental, premiums and prizes, and using the funds for personal use.

      Director of a tribally funded program using program generated revenue for personal use and to fund the then Chief’s campaign for a national organization office. The program was giving selected Osage members benefits of the office without charge or reduced charge. This was done by payment of a personal credit card whose charges were paid by the tribal program and concealed by an accountant in the Osage Nation Treasurer’s office and false reporting on offices transactions.

      Director of tribal program receiving mileage for personal vehicle, while purchasing fuel and oil for said personal vehicle. Purchasing items for program use, but installing them in personal residence.

      Director of tribal program taking trips funded by federal program and visiting family members instead of attending program trainings. Misappropriated laptop computer for personal use and three cell phones.

      Investigation of allegations of medicare fraud, employee drug use, and misappropriations of funds was done on Home Health. This was stonewalled by the Principal Chief’s Office, due to the possible repayment of funds to federal government.

      Submission of a reimbursement claim for meal purchases, that contained the cost of alcoholic beverages by an elected official.

    2. Time Line of Osage Nation Office of OFPR— Part 2

      3/2008 to 6/2018

      Office of Fiscal & Performance Review was staffed by Senior Internal Auditor and opened office.

      Developed policies and procedures for office, Congress requested an audit of Bartlesville Casino construction cost over runs.

      The Principal Chief filed an injunction blocking the operation of the OFPR on grounds of “witch hunting”.

      Office aided Congress as Budget Analyst at several different times while the law suit was in tribal court.

      The office was able to get Osage Gaming Commission records on Bartlesville Casino construction and after examination gave a report to Congress.

      Senior Internal auditor aided the newly appointed Controller of the Treasury in putting uncovering a scheme in which an accountant in the Treasury was embezzling funds from a program that they handled. It was done by skimming cash from daily deposits and reporting uncollectible fees owed to the program to be written off by the Treasurer. Controller was then fired by the Treasurer.

      After a new Principal Chief was elected to office, the lawsuit against the Office of OFPR and the Senior Internal Auditor was dropped by the new Chief.

      Operation of the office was started, administrative assistant and staff auditor was hired. Audit Plan was developed and audits started.

      Audits of programs revealed a lack of policies and procedures for operation of the programs, insufficient checks and balances on expenditures.

      Office audited the Pawhuska, Grayhorse, and Hominy Indian Villages after much resistance by the Village Boards. One village lacked support documentation for more than $800,000 in expenditures, resulting in replacement of the board and personnel. Another village where the board chairman would not cooperate on presenting of records, lack of required meetings, board member who had been deceased for several years had not been replaced and board member who was ineligible for position. The other remaining village was very cooperative and there were no exceptions noted.

    3. Time Line of Osage Nation Office of OFPR— Part 3

      Audits revealed the lack of securing of records by many of the programs.

      Audit of a federal program revealed the expenditure of funds for purposes not approved by the granting agency.

      Audit of a tribal department revealed expenditure of “restricted – use” funds for purposes that did not meet the requirements of the use of the funds. Lack of required records on file by the department.

      Audit of tribal department revealed that Director had formed a ghost business to do contract work for the department, that the director was only reported to work 25% of the days that he was paid for. Fraudulent time sheets were filed by the Director and signed by the then Director of Operations. Restricted Administrative password to Osage Nation Computer Network was passed to non-approved employees allowing them to review any employees’ emails and other data.

      A tribal department employee used tribal equipment to dismantle metal reservoir, sometimes on tribal time. The metal was then taken to a salvage metal purchaser at Turley, OK and sold. Funds was retained by the employee and an Osage Nation member for their personal use. All this was done with the knowledge and approval of the Director of the tribal program. When this was discovered all information obtained, including videos were given to Osage Nation Police Dept. investigator, no action was taken for several months. When OFPR released the report, charges were filed the following week.

      OFPR took the initiative to set up and put the Whistle Blower Hotline and the review committee in operation and administrated it’s operation.

      OFPR reviewed the operations and reports of the Osage LLC, as a result a restricted report was given to the Commerce Committee of Osage Nation Congress in executive session. Listing the concerns of OFPR and the Osage Nation Attorney General in the operations of the Osage LLC and it’s subsidiaries. This was in October of 2013. The concerns were not given to the Osage LLC offices till December of 2013 for response. Investigation into this area was met with resistance from Congressional leadership at that time.

      OFPR audited the shelters operated by the Osage Nation, which resulted in finding of insufficient security of operations, lack of sufficient records, practice of leaving employees in their positions while being investigated by law enforcement. Employees not having sufficient certifications and qualifications for positions that they were holding.

    4. Time Line of Osage Nation Office of OFPR— Part 4

      A tribal department was audited and the software program being used for the department’s operations was found to lack the security for reliable records or tracking operators inputting information. Also, the issuing of notary public certification of fraudulent titles. Titles being issued on non-titled vehicles. Resulting in the recommendation that the Board over the department be relieved of the oversight of day to day operations of the department and put it under the Principal Chief’s Office.

      OFPR brought to Congress’s attention that they should as for the “Budget to Actual” reports on the construction of the casinos at McCord and Skiatook. After OFPR had become aware that the construction costs were exceeding the amount of funding approved in the “Plan of Operations”.

      Review of records and contracts revealed that Competitive Bidding requirements had not been met by the Osage Casino and Gaming Enterprise Board in the bidding for the construction of the Casinos at McCord and Skiatook.

      OFPR participated in an audit of Osage LLC that was led by a contracted auditor of the Principal Chief’s office.

      OFPR adopted the practice of attending all bid openings and running a concurrent audit of any construction project being funded by the Osage Nation.

      An audit of a federally funded program revealed that no receipts were obtained or records maintained supporting the issuance of monetary, supplies, and items of value assistance to clients of the program. No inventories of the supplies and items of value were maintained.

      An audit of a federally funded program revealed that assistance was being given to clients that were not qualified for the program’s assistance.

      An audit of a tribally funded program revealed that some employees were expending funds for personal use, proper security of inventories on hand was not being maintained.

      An audit of a federally funded program revealed that proper records or reports were not being maintained. Auditor assisted the personnel in starting a policy of maintaining records. Director was absent most of the time.

      An audit of a federally funded program revealed that personnel and client records were not maintained with the proper security required by law.

      Concurrent audit of Casino Construction noted and reported a “Competitive Bidding” violation to Congress and Attorney General’s Office and a situation of a contractor (individual) double dipping or being paid twice for the same job by a contractor and the Osage Casino.

      Note: The presence of OFPR and its’ staff served in an intimidating role for the compliance with Osage Nation Statutes and federal laws concerning the operation of the programs and departments of the Osage Nation. Much like the Highway Patrol or Police Departments serve in encouraging citizens to comply the laws merely by their presence, for fear of being caught in any violation.

      The annual audit performed by an outside audit firm only audits those entities that have a material amount of expenditures and are federally funded. They have been shown that they do not check for tribal law violations concerning operations or audit tribally funded programs or departments except those requested by the Treasurer.

Nothing was ever done about this. When the Tulsa Casino was built recently there had been changes in the law that allowed the OFPR to consistently monitor the construction by reviewing bid solicitations, attending bid openings and reviewing all applications for payment. That casino construction ran $30 million under budget. We can’t give all the credit to the OFPR but it certainly was a factor in helping to reduce costs.”

    9. Perhaps this year will be the "Mea Culpa" year of the Osage Nation government. Never mind the AG who appears and has been alleged time and time again to follow the Osage Nation line where the will of the Chief is concerned, what we really need here is an outside Independent Special Prosecutor to investigate these charges associated with this list with infractions that have taken place over the years involving both Federal and Tribal funding. From what it says, "...(audits) do not check for tribal law violations concerning operations or audit tribally funded programs or departments except those requested by the Treasurer." That fact right there ought to alarm every Osage Nation member into a demand for operations, programs and departments with Tribal funding to be audited back to day one by the Special Prosector or land a few people running this thing in jail. This couldn't be more serious and the Osage people are now under an obligation not to put up with it and to call for the Chief's and Assistant Chief's ouster if a Special Prosector isn't appointed. I want to know about all this alleged money flowing from one budget to another and one departmental budget to another in the Executive Branch and since the Osage Nation Supreme Court members have allegedly been responsible for "allowing" such unethical and improper "wide open" movement of Tribal funds to take place in the interpretation of their ON Supreme Court opinions, I would like them included in the investigation by the Special Prosecutor. Obviously, if we've lost one Treasurer over moving money around that was not reported under the law in a timely manner to the Osage Nation Congress, then this should see particular and exhaustive scrutiny.

The first thing I feel should be mandated on an immediate basis is a professional outside accredited Ethics Course that has to be attended by every single employee of the Osage Nation government as part of the employee training program including all elected and appointed officials to include every single individual who collects a paycheck from the Osage Nation government with an independent employment contract arranged for by the Chief. Anyone who fails the course, loses their job. Simple as that. Under the current circumstances, calling such a measure "harsh" is utterly ridiculous at this point in time. Employee training, initial and ongoing, is part and parcel of the working environment for both Federal and Private Sector employees so any excuses on this basis simply aren't legitimate.

In most instances where this kind of corruption exists and it comes out in the open publicly, there usually a large outcry on the part of the elected and appointed officials to investigate these kinds of allegations promptly, hold those who are engaging in such activities responsible and if found to have foundation, to get each case before the court in a timely manner and I don't mean in one or two years later. The excuse has always been, it will hurt the families if all this comes out in the open. The faith, good will and belief of the membership in the Osage Nation as a credible and honest government without harboring or corruption of any kind for any reason on the part of the elected officials takes precedence here and the Osage people do and should demand it of those who are running it. If something has been set aside by one Chief in a manner inconsistent with the law then it's incumbent upon the current Chief, The AG and the Congress to get to the bottom of it and bring those illegal acts and those responsible for them to a lawful conclusion. I'm waiting to see if we have such an outcry on the part of our elected and appointed officials by Press Release on the Nation's website or in the Osage News in the next few days or if this Report and what's listed on it is ignored by them.

Clearly from the DEAFENING SILENCE IN THE LAST WEEK SINCE the publication of the Report of Kelly Corbin and the items on it, WE NEED THE OSAGE NATION CONGRESS TO FORM AN OVERSIGHT AND REFORM COMMITTEE! If we have items that the Office of Fiscal and Performance and Review (OFPR) turn up, then we need an official Congressional Committee to handle them. This is an essential part of the POWER of a Congressional body to exercise OVERSIGHT AND REFORM. The job is only half done if the Congress has no place for infractions to be reviewed and action to be taken to include Official Hearings to get to the bottom of what is going on. This includes the POWER to call other elected and appointed officials from other branches of the government to account for themselves in these hearings. If they know they will be held accountable to the Osage people in a public forum, it will give them pause before they choose to break the laws of the Osage Nation or GET CREATIVE with them. This also includes the Power to hold members of the ON Congress accountable to the Oversight and Reform Committee as well if their actions turn up on the OFPR reports to the new Committee. One of the main promises made at the time that the new government was being discussed was that a democratic constitutional government would clean up all the corruption that had gone before in the Tribal Council form of government. This is true if there is actual participation on the part of the Osage Nation members through working with the Congress and if that fails, then through the Constitutional processes of Citizen Initiative, Referendum, Recall and Amendment to the Constitution by Petition. Speaking of laws that have never even been implemented and established! The Supreme law of the Land is the Osage Nation Constitution and it has been since it was ratified in 2006, THIRTEEN YEARS AGO. How negligent and neglectful is the Chief and his Executive Branch of government for not making certain that these tools are all freely available out of the Osage Nation Election Office to the members of the Nation no matter where they live? Doesn't that fully and squarely qualify as "willful neglect of duty" under Article XII, Removal, Section 1? What is he afraid of? Something happening like what happened to Chief Red Eagle except coming direct from the Osage people themselves? The Election Office comes directly under the Executive Branch of government and the "Supreme" power of the Executive Branch is directly vested in him and him alone. That means that he is "absolutely" responsible for this negligence and neglect in not making sure that the law has been executed and implemented so that the Osage people have these tools to use IN THEIR OWN RIGHT AND THE CONSTITUTION CONFERS THOSE RIGHTS UPON THE OSAGE PEOPLE IN PLAIN ENGLISH AND IN NO UNCERTAIN TERMS!

      Section 3.
      Petition for Initiative or Referendum:
      After certification of the application, a petition containing a summary of the subject matter shall be prepared by the person authorized by Osage law to do so for circulation by the sponsors. If signed by qualified Osage voters who are equal in number to at least (15) fifteen percent of the electorate, it may be filed.

      Section 4.
      Initiative Election:
      An initiative petition may be filed at any time. The person authorized by Osage law to do so shall prepare a ballot title and proposition summarizing the proposed law, and shall place them on the ballot for the first election held after adjournment of the legislative session following the filing. If, before the election, substantially the same measure has been enacted, the petition is void.

      Section 5.
      Referendum Election:
      A referendum petition may be filed only within ninety (90) days after adjournment of the legislative session at which the act was passed. The person authorized by Osage law to do so shall prepare a ballot title and proposition summarizing the act and shall place them on the ballot for the first election held after adjournment of that session."

The grounds for recall of a judicial officer shall be established by the Osage Nation Supreme Court. The grounds for recall of an officer other than a judge are serious malfeasance or nonfeasance, during the term of office, in the performance of the duties of the office or a conviction, during the term of office, of a felony or conviction of a misdemeanor involving moral turpitude. After certification of the Application, as set forth in Section 2 of this Article, a petition for recall shall be prepared by the person authorized by Osage law to do so and the petition shall set forth the specific conduct that may warrant recall. A recall petition may not be issued for circulation by the sponsors until the Osage Nation Supreme Court has determined that the facts alleged in the petition are true and are sufficient grounds for issuing a recall petition. A recall petition must be signed by qualified Osage voters who are equal in number to at least fifteen (15) percent of the electorate. Upon a determination by the person authorized by Osage law to so determine that a petition has been signed by at least the minimum number of eligible voters, a recall election must be conducted in the manner provided by Osage law. The incumbent shall continue to perform the duties of the office until the recall election results are officially declared and, unless the incumbent declines or no longer qualifies, the incumbent shall without filing be deemed to have filed for the recall election. A recall election may not occur less than six (6) months before the end of the officer’s term. An officer who is removed from office by a recall election or who resigns from office after a petition for recall issues may not be appointed to fill the vacancy that is created. Additional procedures and grounds for recall may be prescribed by the Osage Nation Congress.

      Section 1.
      Grounds for Removal:
      All elected and appointed officers of the Osage Nations shall be subject to removal from office for cause, including but not limited to WILLFUL NEGLECT OF DUTY, malfeasance in office, habitual abuse of alcohol or drugs, inability to meet qualifications to serve, conviction of a felony or conviction of a misdemeanor involving moral turpitude while in office."

      Rules and Procedures:
      Removal of Osage Nation Officers shall originate in the Osage Nation Congress, except as otherwise provided in the Osage Nation Constitution. The judgment shall not extend further than to removal from office and disqualification to hold and enjoy any office of honor, trust or profit in the Osage Nation, but shall not prevent proceedings in the courts on the same or related charges. The Osage Nation Congress may prescribe additional rules and procedures that are necessary to implement the provisions of this Article."

Millions and millions and millions of dollars have been spent in Osage County on one thing or another that have taken benefits away from the Osage people and this has been inequitable from the beginning of this government that has shafted the great majority of the Osage members to suit those in elected office including the Chiefs. GSB has only one choice and that's to slow down and cut way back on spending in the Osage because those benefits belong to us and they are needed for all Osages who utilize them. There will be huge blow back if the Chief's plans move forward to the detriment of the whole of the Osage people and they lose any of the benefits they deserve to have under the Constitution no matter how the AG or the Supreme Court sees it.

    All I've heard from day one is that a TERA diminishes the Trust Relationship with the Tribes and the Federal Government and most Tribes have avoided them for this reason. We must have an explanation as our Trust Relationship regarding the Osage Minerals Estate is U.S. Congressionally mandated (1906 Act as Amended) and the U.S. Congress MUST weight in IN WRITING before we even consider going in this direction either by an Act of the U.S. Congress to amend the 1906 Allotment Act or other written mandate separate, apart and specific to the Osage Nation/Osage Tribe by both Houses of the United States Congress!

    6. What we have here is a completely undoable situation. Clearly whatever the Utes are doing is not associated with a TERA because it just became law in December of 2018. So, are we expected to be the legal test case or the guinea pig as it were? I don't think so. Secondly, there is a moral imperative here and an ethical aspect involved in spending the Nation's money of all Osages who do do not receive Mineral Estate headright income no matter where they live in favor of those who do without asking their permission in a duly authorized election which we cannot afford within the given time period in which it's to take place. If we have structured an election for gay marriage, I submit that spending the public funds which are the Osage people's money on the Shareholders exclusively when non-Shareholders are having to go without, then it should be put to a vote in a General Election. By the same token, there should also be a Minerals Council election of the Shareholders as well as to whether or not they want to be involved in a risky, untried and unproven scheme that requires so much Osage Nation legislation, a new Federal governing body (Indian Energy) with authority that has never had jurisdiction in Osage County before and gamble on a new Federal law that no Tribal community has ever been involved with or tried to make work in practical application heretofore. The risk is through the roof no matter how you look at it and within the specified time period designated today, it's just not reasonable or prudent to throw the dice on this ill-conceived option that's really no option at all.

Many good questions are being asked that I'm sure were addressed in Executive Session even though the money from the Minerals Estate Trust comes to the Headright Owners who are the Beneficiaries and who are the very last ones these days to receive full disclosure from either the Osage Nation government (the Chief) or the members of the Minerals Council who seem to act more like representatives of the Osage Nation than they do of the Shareholders who elected them. The mineral rights income from royalties and bonuses, other than the funding from the drawdown, does not benefit the Osage Nation or any office, department, agency or instrumentality of it. It benefits the Headright Owners whose real financial interest, of supreme importance, is the first to be protected, not the last.

There are two reasons for Executive Sessions and one is for legal matters and the other is for personnel matters. Is this about the legal opinion from the AG that the Chief is seeking on benefits being "more important" under the Constitution for those who live in the Osage than benefits for those of us who live outside Osage County when no such designation exists or should exist?     1. No, but the Enterprise Board (being the real Managers of these LLCs) have dragged the Osage name through the mud. Given the poor financial condition of Osage LLC and its subsidiaries it should not have come as a surprise to the management that the bank would not work with them to restructure debt.

      Creating several new companies with Summit in the name won't solve their underlying problems. It may convince a few uninformed customers and suppliers to do business with them initially, but long term they are doomed to failure. For any business to survive it must have revenue greater than expenses.

Including the consequences of failure? I cannot tell you how blown away I am and others are as well that this has taken place in the Commerce, Gaming and Land Committee Meeting on April 22, 2019. The whistle has been blown loud and clear and those who are making these decisions had better well start paying attention and curtailing any future plans if it involves taking on any loans or any additional major debt obligations until that monster loan with the Bank of Oklahoma is paid off❗❗❗

    2. The representatives of the bank likely showed up to remind the Nation about the terms and conditions after the management of Osage LLC attempted to renegotiate its obligations. For any business to be successful the revenue must be greater than expenses, and taking out a loan to delay the inevitable usually results in prosecution for fraud.

      When I listened to Kay Bills' proposal last year for getting a loan it screamed bank fraud. If Osage LLC goes into default and the bank becomes aware of the minutes of the meeting then the plan will implicate everyone present in conspiracy. Given that some of these people are attorneys you'd think they would understand the common criminal laws such as fraud.

Now we're finding out that certain members of the Congress -- if any -- ever saw the Contract for this loan where the Bluestem Ranch was purchased and the money had for the build-out at the Tulsa Casino. In particular, they didn't know that the collateral for the loan is the revenue generated at the Casinos which is our life blood! This one has Chief Goof Ball's name written all over it and this should be the subject of a Congressional Hearing along with a number of other massive money amounts spent or lost that shouldn't have taken place involving the Permanent Fund and one other investment of $141,000 that dropped to $0 because the shares are worthless.
