    1. Amazon is putting a windfarm in Scurry county Texas to make money and help with the "Global Warming" problem. The Bluestem Ranch would be a great place for Amazon to expand this effort. Amazon CEO is one of the richest persons in the U.S. The Osage Nation will loose the suit as no minerals are taken and the land owner can build on his land.

    4. This sounds like someone with a vested interest in making a huge buck off the Bluestem Ranch area would say. Gee, I wonder who that could be? The Osage Nation government would profit. The people who delegate the funds would profit. Then of course the bribes and under the table deals to make certain people would profit big time.

As usual the Osage general public will be fed a bunch of buffalo chips about how wonderful the wind farms will help the young and old alike. The Osage people will receive no benefit whatsoever from the Ranch or wind farms. But hey, it's the government money, right? They're going to do what’s in their best interest despite what the people think.

    5. .....The Osage Nation ..."will loose the suit"....... as no minerals are taken and the land owner can build on his land.

That is a very interesting thing to say. What suit? ….lose the suit? Really? Why is this person so confident about such an outcome and why does he want the Osages to lose?

What is this person projecting and why? Who is the Plaintiff, the Osage government or the MC? Someone is having a conversation somewhere and is putting his thoughts on this blog.

McGraw-Hill destroys textbook to placate pro-Israel bloggers
At one point in history, it was the same when people cried out, anti-Nazi bigots and they were left alone instead of taken to task. Israel has been appropriating land with illegal settlements on Palestinian land for decades. The U.S. supports this and it's wrong. The UN put in place the mandate and charter for Israel and they can damn well take it away.

Tallgrass is being run by Jill Jones as the general manager? Isn't she the wife of former AG Jeff Jones who the Chief GSB tried to replace but he had some sort of Federal prosecution designation and had to be demoted rather than be let go from the employ of the Osage Nation altogether? Now were paying for an AG in addition to an Assistant AG if I'm right. Plus Jill's collecting a salary from the ONES Board she still sits on as well. JUST GREAT!

When you pay these non-Osages at the helm, CEO, CFO and COO, an exorbitant salary and benefits and then close up the options, by an Act of the Osage Congress, for the Osage Nation as the member to get in there and take a look at what is going on with the day to day, according to the Harvard Project model that is a school of government entity not one of economics, this is what you have to deal with. Trust with verification is apparently a part of the game plan they know nothing about and wish to know nothing about either.

BHT has a story on the Osage Nation filing for a $1 million default judgment against three companies that were once part of the Osage LLC., in the October 13th 2016 issue.
    https://www.facebook.com/Bigheart-Times-130472647019594/

The only thing the Osage Nation knows how to do is get itself in trouble legally, lose assets like the reservation and exorbitant amounts of money. With this running track record that continues on a daily basis, if the BIA approves a compact to run the minerals estate by the Osage Nation, it will be tantamount to gross dereliction of duty under the fiduciary obligation it has to the headright owner beneficiaries of the OME Trust.

    AnonymousOctober 21, 2016 at 10:59 AM
The Osage Nation can't apply to compact the Minerals Estate. They are a renegade organization that Hepsi and the OGRC created out of thin air. The 2004 Reaffirmation Act of the U.S. Congress clarified that a new government can be formed and additional membership chosen for THE OSAGE TRIBE. PUBLIC LAW 108–431—DEC. 3, 2004 118 STAT. 2609 didn't even authorize so much as a name change. The Osage Nation owns nothing associated with the Osage MIneral Estate, the mineral rights and I believe not one single property in trust or anything built on it. The OSAGE TRIBE owns it legally and certainly the BIA has to know that this is the legal truth of the matter.

    1. To poster 10:59 AM. I think you hit the nail on the head. I have been saying this for quite sometime. I do agree with you.

      Delete
    2. Raymond Redcorn believes that the Osage Nation government owns the Minerals Estate. Jim Gray sold us out and Wilson Pipestem argued that the HHP money belonged to the Osage Nation government – not the Shareholders.

The people in power want us to forget the 1906 Act and make us believe that PL108–431 "replaced" the 1906 Act.

Yes, we know PL108–431 was an affirmation to change government if and only if the shareholders wanted to change governments. Non-shareholders were allowed to vote on matters of which they had no right. But money was to be made people wanted to get rich. Today, friends and families of politicians are living quite well with exorbitant salaries far above what would be normal in the corporate world.

The Osage Nation government is about money, power, and political influence from the county level on up to Washington D.C.

      Delete
    3. Also Pipestem, I believe, put forward the idea that the shareholders had no legal rights in the HPP lawsuit. I believe it was Federal Judge Frizzell who stated that the Osage Nation had no right to waive the rights of the shareholders and that they had standing in the HPP lawsuit in the Court of Federal Appeals. That put the Osage Nation back in its place from then to today. I contend that the Osage Nation had no rights because they don't even own the mineral rights or the income before it is taken into trust and placed into the trust account for the headright owners. The only owners here are the Osage Tribe with the mineral rights reserved and all those OME Trust beneficiaries who still have membership in the Osage Tribe which includes all living Osage Headright owners.

  4. Employees caught in the middle of Chief and Congress feud. Huh, really Chief you started this we can end this. The employee who is complaining is ignorant. Merit employment requires that you do the best, because your position will not be safe. It will allow you to grow and recognize your abilities and requires good moral and good work ethics. It will allow you to climb the latter. If you did a great job that year on your anniversary you will see a raise providing the right circumstances permits. I know this creates competitiveness from with in to inspire. To this employee who made a comment about Edwards, we Osages be it we may be out of state but remember why and how this happened if you understood our Culture you would not make such a racist remark as the one you did. You see some of us come from Great History rich in Culture. You insult our intelligence, what the vote is at best 2% of Osages who voted or just a little higher, do the math and you tell me we voted to keep Edwards in Office, really. What I find troubling is why such a low vote? But keeping on point...shame on you Chief in this instance you are wrong and we suspect why that your overhead is higher than suspected and not in alignment with the area you live in and way above the cost of living. www.osagenews.org

    2. As far as I'm concerned the employees who never answer the phone, never return a message left or when they do, are rude or act like they are too busy to fool with you can MOAN AND WHINE THEMSELVES TO DEATH !!!!!! Formerly they had 260 hours (32 and a half days!!!!!!!!) of paid time off! I don't believe that this includes vacation time on top of that plus they also have bereavement leave. You talk about OSAGE NATION EMPLOYEES USING THE CULTURE TO GORGE THEMSELVES WITH MONEY AND TO TAKE TIME OFF AT OUR EXPENSE. This is detestable !!!!! Where in the work world do you see compensation packages like this? NOWHERE EVER UNLESS YOU HAVE EMPLOYMENT COMPENSATION THIEVES WORKING FOR YOU! Then you look at this:
"Employee base pay, benefits, merit bonus, special adjustment and the cost of non-monetary recognition shall not exceed 52 percent of the tribal and non-tribal projected revenue." FIFTY TWO PERCENT? It shouldn't be anywhere near 15% at the outside maximum of the entire budget. You want to know where your tribal benefits are going? It's right here with $57,750,000 going to pay the employees who barely deserve the honor to work for the Osage Nation! These people are eating us alive and the elected officials are letting them them get away with it! I am creating a new acronym for the Osage Nation workforce who think they are so entitled and in their dueness believe they have the right to rob us blind: GDE = Greed Driven Employees.
“The practice of hiring and promoting employees, esp. government employees, based on their competence rather than political favoritism.” YES CHIEF that's correct. What we have in place right now is far from it. (Nation’s Workforce Pay for Performance Act with the Merit Based Employment System Act). Who is the CEO of the Osage Casinos and how are you related to him (after that Board meeting where you yelled and screamed at the Board members until they finally agreed to vote to put him in as CEO). In addition, what position does your own wife have with the Osage Nation today? This remark is so rich coming from him I can't believe he had the audacity to make it out loud.
Read this monstrous stuff the GDEs are getting away with at http://www.osagenews.org/en/article/2016/10/21/employees-caught-middle-chief-and-congress-feud/

      Delete
    3. The only way this could even be happening is if the Osage Casinos are being robbed of necessary operating capital or they are appropriating the money from the loans somehow or both. Ten years and look at this puke being spewed all over us by these incompetents and ignorants who barely know how to drive to work never mind get any work done while they are there !!!!!!!!!!!!!!!! The job too much for you? Well then take the day off???????? Make these people send faxes to the Executive Branch offices the minute they come in to work, the minute they leave for any reason and a fax when they return during regular working hours and when they leave the office at the end of the day. Anyone who won't go along is terminated immediately. Start recording the conversations and establish a written record of the time it takes to return a phone call to a member of the Osage Nation if a message is left on the recorder. OMG! Here we are struggling to make ends meet and the averaged salary of all Osage Nation GDEs at 486 of them is $71,000 including benefits!!!!!!!!! $24,500,000 (52% of $47,000,000) in Tribal funds and $10,000,000 (40% of $25,000,000) in Federal funds. Is this what you thought would be happening 10 years ago? Government raiders and thieves all around !!!!!!!!!!!!!!!! No wonder GSB wants his budget numbers opaque and hidden from the Osage people.

    5. There are companies who shop the job performance of employees both in the government and the private sector. I'd like to see one of the best hired to swoop down on the Osage Nation government from top to bottom and have the report published to the Osage people. Hell, we could even come together, raise funds and hire a company to do a top down review of the Osage Nation government ourselves... They call it "being shopped."

    6. On average for the 50 states in the Union, some 20 percent of state spending is for employee compensation which includes salaries, wages and benefits. Where does the Osage Nation get the right to spend double and a half more on employees who probably couldn't get a job anywhere else at that pay structure for what they are hired to do but at the Osage Nation? We are being taken for a ride big time and this article in the Osage News really proves it. Is the structure of the Osage Nation government from a bureaucratic standpoint that important or is it just an abominably selfish way to keep the money out of the hands of those who don't live in Osage County?

      Delete
    7. Now this is a conversation. All of you are right and point on. In my opinion I don't think every Osage Shareholder got a vote to weather we were to become a Government of such in 2006. PL 2912 was to allow membership to all Osages and we can turn the tide. End this sham, end this sham! We are the Osage Tribe not a money Government grabbing sham.

    8. It's PUBLIC LAW 108–431—DEC. 3, 2004 118 STAT. 2609. It was HR 2912 (U.S. House of Representatives bill before it was sent over to the Senate for their version). The final draft of this Act of the U.S. Congress of was sent to President Bush for this signature and once signed into law it became and is today PUBLIC LAW 108–431—DEC. 3, 2004 118 STAT. 2609. Continuing to confuse everyone by referring to HR 2912 is perhaps not the best idea.

      Delete
    9. In case it's in dispute that the Osage Nation is out there somewhere well beyond the pale, let me direct you to this phrase in the same Act, PUBLIC LAW 108–431—DEC. 3, 2004 118 STAT. 2609:

"(U.S.) Congress hereby reaffirms the inherent sovereign right of the OSAGE TRIBE to determine its own form of government."

There it is in black and white and that's the sum total of it. Again, just like with the Osage National Council government back in the 1990's, the BIA and the Secretary of the Interior grossly erred in not minding the store from a fiduciary standpoint for the Osage Tribe as a legal entity and the legal Osage members with headrights as beneficiaries because it should have caught this Osage Nation business as soon as the draft copy of the Constitution hit the street in January of 2006 and sent Hepsi, the Harvard Project and her band of merry interlopers on the OGRC right back to the drawing board. When will the BIA ever learn to play the game according to Hoyle? They all need a good legal course in what a fiduciary obligation means in such a relationship to a beneficiary or beneficiaries.

      Delete
    10. Ok so I made a mistake HR 2912, but my point is of the same and still the same The BIA grossly errd. And playing to Hoyle is a understatement, had we remained the same we would have not lost the Reservation case.

And the reason they did it this way was because of tax purposes right? 2. Higher education isn't this program for grades 1-12 3. Burial assistance is way cheeper than giving a per-cap out when they the Osage Government knows most have this covered. So what is our Government doing other than creating more regulations?

    3. Corruption happens because the people in charge not only make it happen; they make sure it keeps happening.
They don’t see it as corruption. As gaming the system. There was a pie, a very large and tempting pie, and they saw how people with access to the pie kept cutting off huge pieces for themselves, so when they got a chance to decide how big their piece would be, they did not think, “I will leave as much pie as possible for other people.” They cut themselves a generous slice, befitting their status as civic leader. So this is what is going on with our tribe no different than the USA. We have had a rough 10 years to say the least, all of you want to change the dynamics then we have to let our legislative body know this and this is where it begins. This article by Jame Giago Davies is a columnist for Indian Country today. He posted on INDIANZ.COM Corruption keeps the privilege in power. But what is happening here could we be in the middle of a new movement, we could be. This much we know the Osage needs a voice and it's not GSB. Long live the Osage Tribe and bless our People.

Knuckleheads. Yes. To put it that nicely is obscene. We vote for who runs for office and the election office with its election law changes is making it more and more difficult to run for elected office if you don't live in Osage County. Now I think you have to be there in person for your own recount as a punishing measure for even having slapped down the $500 for the recount because they tried to get away with only counting your votes, because hard work was so difficult for them to endure even for the two days it took to recount the votes, and all because the public went ape s**t over a one candidate vote recount. Sickening. Someone needs to step up outside the circle and run for office as a "clean up the corruption and get the locusts off the payroll" candidate. These elected officials are afraid of the Osages they serve in-county. You can smell the fear when they vote for budget bills that are so rude hell itself wouldn't have it. I firmly believe it's more than just being reelected. At every contentious vote, for example, Archie Mason always seems to be absent.

Our "Casino's", what they do not want tell you is it is fluid enough to get a piece of that "PIE". Thats another secret that they do not want to share with you. Wow the word INTENT is and the meaning behind that word and what that means to the OSAGE. In other words the Intent of becoming a Government was built around the Casino's and the Intent was to share that piece of the PIE right. I know the truth and so do you. By chance always looking to support what I have been saying for a while change needs to come to the Osage in a big way time to end the Nepotism and Cronyism and get to work on real issues that plague are long over due Villages and surrounding neighbors by building our infrastructure and we sure do not do that by buying a empty bank or throwing 74,000,000. at a Ranch that is now in dispute and the rhetoric that surrounds the politics on the reservation, oops we don't have one any longer because the diligence was lost somewhere in the quagmire or as I coin it, lost in communication and by no accident. Should we wake up to the reality the Osage has been had? After watching the elections this year, you can't help but see how we are in the same boat. Hillary and the scandal that follows her and thats her burden she created this dirt and no one is to blame but herself. My point you dont have to look far to see how our Government parallels Hillarys scandals. Joe forgive me MahaskaShay did I spell it right and the some to the board members of the OSAGE LLc. 8. The only realistic hope for the Osage is a new constitution. The current government is just bloat. Its like what happens when a hoarder lives in a big house. They have to fill every available space with detritus.
A chief, assistant chief, and three representatives for each district. No term limits, but have provisions for elections if our for-profit businesses fail to meet expected financial goals.
And have a provision that keeps the government out of the culture.

    9. That's one representative for each district, not nine representatives.

    10. How about rewrite the Constitution and restore the Government back to its original true body the M.C as per the 1906 Act as amended? Becuase our Constitution mirrors closely the U.S Constitution. That being said with the laws to prtect against the huge conflicts of interest, needs to change and fast. 10 years of this and what has been done except Government bloat. At least Ewards is trying to do something about it, like curbing some of the entertainments and saving a buck or two, ie. Merit pay vs. principal pay. That girl who is passing this petition around just because she wants more paid leave really? 4 weeks is more than enough now she wants time off when in the real working world even this does not happen. Not only that Merit pay is better in the long run. Her raises will go up and stay that way, being awarded does not pay in the long run and she is cutting her nose to spite her face. Whatever survival sense that kept the Osage alive through the centuries was clearly supplanted at some point. Replaced with a kind of artificial hubris. Say all the right words in the right order, and people will assume a level of depth that isn't really there. That the person speaking is just mimicking those who came before, who were just mimicking those in the tribe who actually had that depth of understanding.
Likely the result of some kind of chthonic infection. Some witless idiot was allowed to play with things they shouldn't have, and the next thing you know its the industrial revolution with all the dehumanizing effects its brought.

This was the one where one from one of the big landowner families in OC recused himself and the one that took over the case did exactly what the recused one would have done. Get your facts straight before you go criticizing the MC. That's why SB wanted to get into the case and try and correct things but OC is in play now and the non-Osages are making their move that they have waited for ever since they bought the land. Jim Gray and his folly with trying to get out of paying state taxes for one single employee and that tax lawsuit that took away the reservation status in Federal Court was the in on taking away those mineral rights and if they can't get them back they will put up wind machines all over OC to stop the Osages from drilling. It's a mess all brought about by this interloper Osage government headed up by Hepsi Barnett, the OGRC and Jim Gray who was the go to guy on this catastrophe. Place the blame where it belongs for once and not wherever you feel like.

    1. Earlier this year the TED board (OLLC board, too BTW) was talking about the $6 to $7 million in projects the construction company would complete by year end. They claimed to be making a 10% margin. Add to this the $1.5 million already available to TED's construction company for bonding and there should be no need for another $1 million in funding for bonds. What are they doing with the money?

      Delete
    2. That's the million dollar question and inquiry is needed before this money is allocated? The board needs to be more transparent. Or here we go again have we not learned from the past? ie,(Osage Llc)

      Delete
    3. Actually, TED is in reality Osage LLC. The subsidiaries are still listed in SAM.gov as Osage Innovative Solutions and Osage Pinnacle Design Group. According to the last public report by the Enterprise Board, these companies had not been formally transferred over. Why? Because transferring these companies away from Osage LLC would jeopardize their 8(a) Small Disadvantaged Business certifications.

      Delete
    4. Hmmm? It would be prudent to make the move complete, since the Osage llc is not performing, and no longer the parent company? To insure no corruption or the appearance of impropriety is not occurring? Is there any distributions and if so, where is going to? Back to the Osage? Mostly, is the Board the same people who were on the Board of the Osage llc?

      Delete
    5. The recordings of the Com Econ committee will answer most of your questions. Technically, the former OLLC board was appointed to the TED board and OLLC no longer has a board. However, the TED board continues to manage OLLC in addition to controlling TED. For all intents and purposes, TED is just an alter ego of OLLC. Same mission. Same articles of organization and operation. Same subsidiaries. Same management (at least initially).

      Delete
    6. Thank you for responding. So now there is a Tall Grass construction, Osage Manhatten Builders, Osage Pinnacle design, a construction company. Hmmmm. So, is TED bringing in the dough or is money being thrown around like its free for all? And what is in place to protect the interest of the Osage and most importantly where are if any the Distributions going? If any?

      Delete
    7. Tallgrass Construction is Osage Pinnacle Design Group. If you look at the record on SAM.gov you'll see that Tallgrass Construction is a DBA (doing business as) for the real company.

As for Osage Manhattan Builders, it was never anything more than a work of fiction to enable Manhattan Builders, a division of Manhattan Construction (the first corporation to exist in OK), to get work based on its "Native American ownership". In was represented to be a joint venture, but it was wholly managed and staffed by Manhattan Builders personnel.

In much the same way, Osage Pinnacle Design Group started out as a joint venture with Pinnacle Design Group. Even after transitioning to full ownership by Osage LLC, OPDG was completely reliant upon Pinnacle Design Group for management, staffing, and performance of projects.

Only recently has OPDG hired a person with skills relevant to the industry and having some potential to run a construction company. That said, OPDG is still more fiction than fact and is reliant upon actual construction companies to perform the projects it takes on.

And or if any profit are we vesting it if any, putting it back into our communities? Save the Osage some money make the employee realize in the long run you will make more money. No job is safe either way. No way do we have $25.5 million in benefits to the Osage membership overall despite the fact that those who live back home receive this amount from the Feds based on our numbers, not on those who live in Osage County. Those who cannot avail themselves of this funding sit at around 88% of the entire membership. This is upside down and they are still skimming 1-2 million bucks off the top of each yearly budget to put in one reserve fund or another to keep it away from all of the rest of us. This should be brought to the attention of the Federal authorities as soon as possible. The Federal funds should be more like 60-65% of what they are now or $16.5 million overall and that's being generous.

    1. The hearing was held on November 15, 2016. A notice of the filing of a 30 page transcript of the proceedings was published on December 8, 2016. Had all of the named defendants appeared in court in a timely manner and made appropriate arguments, all three of the cases would have been thrown out of the Osage County District Court for lack of standing.

Osage LLC was never a legal entity of the State of Oklahoma, nor was it registered as a foreign entity, and as such it could have been prevented from bringing a legal action in an Oklahoma court or even a federal court. However, an argument related to lack of standing under Oklahoma Statutes requires it be timely filed else the courts will let stand a complaint which otherwise cannot be brought before the court.

The victory relies on the defendants ignoring the matter and/or not getting legal counsel eligible to be heard in an Oklahoma court. The cases not being dismissed shortly after being filed is due to the defendants retaining legal counsel unable to research the status of Osage LLC and file a proper motion for dismissal. The ON got lucky with this default judgment.

    2. What we have is a failure of gross competency. And ripe to happen again, the ball was dropped straight cross the board. The Government authorised the appropriation blindly to the OLLC. You can say all day the board was lied to in buisness you verify...verify...verify..and it happens all the time, crony capitalism by all appearances until they get caught with there hand in the cookie jar. What bothers me most is why all these perks and who authorized such expenditures? When does the Osage wake up to the fact if we dont hold ourselves accountable the appearance of impropriety takes more of a sinister appearance, corruption from with-in. And then the next excuse will be well this is all our law allows us and then I say B.S. Because that excuse only works once. Change could not come sooner and it will be the will of the people, the Osage Tribe.

    3. A motion was filed with the Osage County District Court on December 12, 2016 to vacate the default judgment pursuant to 12 O.S. 31.1. How the removal of records or files from the office of the court clerk plays into this case is a question that cannot be answered at this time because the document is not available online for review at this time.

    6. The motion to vacate judgment has been posted. It is actually based on 12 O.S. 1031.1 instead of the erroneous synopsis posted on OSCN.net.

One of the included arguments for vacating the judgment is a statement by Plaintiff's at page 5 of their pleading on November 10, 2016 which reads, "Plaintiffs have not sought default judgment as a discovery sanction." The Defendants further argue that the Court Minute of November 15, 2016 does not constitute a judgment under Oklahoma law. There are two appellate court decisions which held that a Court Minute "could not be considered as a judgment, decree or appealable Order".

While the New Market parties were late in retaining legal counsel, it appears they finally engaged one who is competent. If the judgment isn't vacated by Judge Kane then it will be vacated on appeal. Why doesn't OLLC and the ON retain better attorneys? They certainly pay enough.

Heard from one eminently credible source that she is charging big bucks for her work on the case. She's also the one that's supposed to get the OME Shareholders an accounting of the HPP lawsuit information but something went wrong when she went back into court and from what I'm hearing, she went too far and the whole thing got sent down or set back some way or another. I think they are appealing the case again. Had something to do with her fees or costs as an attorney that were being asked for that the court said she was on a contingency basis and since no money was being asked for in the case, only an accounting, the lawyers couldn't be paid by the court. Funniest thing I ever heard of in my life. Only in the Osage. People have worked on that case for years and years and years and I wonder if anyone as an attorney of record at any given time has ever been paid a dime for their services.

I'd say the playing field is littered with red flags where the Osage Nation government and its accounting process is involved. Taking from one set budget and giving to another set budget? Moving amounts of money anywhere they want and having no rule or policy or procedure or law to stop money from flying around all over the place from one budget to the other budgets in one Branch of government! Simply because the Osage Congress doesn't want to be called back into session to adjust budget appropriations on this basis when needed! I'd say weak internal controls is at the very foundation of this dire situation that is reported to go on all the time with Osage Nation accounting.

Moving money from one line to another does not give you the real figure of the operating cost of that line Item. The appearance is we are always operating at cost when in fact that is not a true figure and then gives you the appearance of impropriety exists. For all intense purposes robbing peter to pay paul and then you have to look futher and follow the paper trail..the red flags are there and there are some who are realizing, there are Osages that are wise to the shenanigans and loopeholes that exists to the disadvantages of the Osage. The whole presentation in this Committee meeting was illegal in the first place under the Constitution of the Osage Nation. As far as I'm concerned, Congressman Tillman had no other alternative but to walk out of that meeting so he would not be participating in an unethical proceeding taking place in an official Osage Congressional meeting.

Went to a legitimate lab for a real test that will stand up in court and the test came back for both us that I am 99% her daughter and she is 99% my mother. Told them about the test we took and the man laughted and said the Native Amercan ancestry can't be defined by a DNA test and therefore a particular Tribal community genetic affiliation or relationship is out the question. 52. It is my understanding the Four Sixes Ranch of Texas delivered two semi-loads of cattle to the Bluestem Ranch today. I am utterly disappointed. The Chief's decision to allow a non-Osage company to profit off of our asset seems reminiscent of the federal paternalism the Osage were forced to deal with over 100 years ago. (In 1896, Henry Foster of Kansas acquired a blanket lease for the entire Osage reservation. He developed our minerals estate and Osages received a royalty portion of the proceeds.)

While acquiring the Bluestem Ranch property the Executive and Congress made provision to operate our own asset.Through Tallgrass LLC the Nation owns Bluestem Ranch LLC--it is well funded and ready to work for us. The Chief and Tallgrass LLC formed the subsidiary for the purpose of developing a wholly owned Osage ranching operation and to centralize the Bluestem Ranch land management. Two of the most persuasive points used by the Chief to gain support for Bluestem Ranch LLC were that the business would have an operations advantage because (1. there is no mortgage payment and (2. the lease payment would be nominal. Essentially, the cost of land is covered by the casino and the board would cover maintenance costs.

The Chief appointed and Congress confirmed well qualified OSAGE board members. The board has submitted an Annual Plan of Operation, which has been reviewed and approved by Congress. It is unclear why the Chief has completely abandoned his original plan presented to Congress, Bluestem Ranch Board and the Osage people. This reversal seems personal in nature. This decision has not departed far from the federal ideology, 'Let someone else work your asset and just take a little of their profit.' Knowing we could have realized the full benefit of our asset and that we were prepared to develop and execute an "Osage" plan, I will never think this is a good idea!

If this is short-term thing, in advance of being ready to run a ranch, it would be a reasonable way to make some money in the interim rather than letting the land go idle.

    6. Probably. But if it aint in writing, it can get messy real quick. A back room, off the books, side nagreement orcontract isn't a good thing either because it can lead to just as many legal problems. If you don't commit the terms and conditions to writing, all sorts of assumptions on both sides can begin to take place and a court will honor verbal leases in court. It's expensive and ugly which in business is just about the only thing the Osages seem to know anything about. Often in written lease contracts, arbitration is one of the terms and conditions which can help keep the two parties out of court. A verbal lease however, on a he said -- he said basis, won't include this method of staying out of court should things turn down.

See also the Meeting Agenda at osagenation-nsn.gov.s3.amazonaws.com/files/departments/Minerals/2017-0112-Exec-Joint-Mtg-increase-oil.pdf

There has been some discussion about this meeting including a proposal for the Osage Nation Energy Services, LLC (ONES) Board to have a blanket lease over all of Osage County given to them by a vote of Osage Minerals Council. There is some question as to what this will do to the power structure of the Shareholder elected Minerals Council to continue running the Osage Mineral Estate in terms of the current ability to consider and approve leasing to the oil and gas producers as well as to continue with the administration, development, and management of the Osage Mineral Estate. There is a second concern that this will perhaps place the ONES Board above the Osage Nation Minerals Agency from a government controlling standpoint in conflict with the specified provisions of Article XV of the Osage Nation Constitution. It has been suggested as a cautionary measure that very serious questions need to be asked of the Chief and the presenters and be fully answered at this meeting before any such arrangement is made or provided for by the Minerals Council going forward.
"The meeting will be a public meeting and is scheduled for 10:00 a.m. on January 12, 2017 at the Pawhuska Business Development Center.”
Address: 1225 Virginia Short St, Pawhuska, OK 74056

I wonder how much that hot-shot from The Harvard Project, Jonathan Taylor, also an OLLC Board member had to do with this and The Harvard Project should be notified immediately of his involvement with this money lending scheme, as the OLLC Board had to have made this cash investment, especially if it was made while he was on the OLLC Board.

If the Osage people hadn't made such a stink about getting justice for the money we could have used, and the Osage Nation ultimately lost as a result of certain members of the Osage Nation Congress not doing their due diligence especially when they were warned about that Leese character, the lawsuit being brought against them in Court in Tulsa would likely never have happened.

How much did Yancy Redcorn get at an agent or broker at Red Eagle Feather of the million buck investment to New Market above the $26,666 on these "sure thing" investments that he was supposedly finding for the Osage LLC.?

  60. "The Harvard Project should be notified immediately." You do realize it's the Harvard project, Gray, Pipestem, and other high society types that created this mess, don't you?

    1. Yep! I do. Been railing about it since before the vote was held on the Osage Constitution itself.

    2. I say it is time to change who we pick as a Chief next time becuase it apparently still spreading the liberalism attitude with in our Government as opposed to the opposite happening. As I have quoted many times you don't have to look to far to see where your dollars are going to, failed projects all in the name of big Government and now we are opening up another Casino all fine and dandy, but look at the meat of the deal who will benefit from this deal outside the Nation? We can end this take of our funding and Negotiate thru voting on this matter how the Osage people would like to direct said funding? After all it is our money right? How is liberalism working? It's not, how is the dictator working, it's not. How is the Harvard Project working its not. Socialism will always fail. Why because it ignores principles and it ignores incentives. Look at the loses in the last, well since 2006. All in the name of economic growth to justify a means to an end, in the guise of Sovereignty. Twenty million gone and probably will never be fully accounted for, and it wasn't like there wasn't public out cry. Transcends to the appearance of impropriety has occurred coupled with the lack of diligence. Gross negligence by the Board, commerce committee faild as did Congress. Once again no accountability from with in. This should have never happened. We can do better. I know common sense and I have more on my little pinky than the Chief has on all 10 fingers. See the forst for the trees. Don't be a Hillary. She is in up to her ears with some stuff that is going to come down the pike real hard. Man the tall tails she told.

  63. Geoffrey Standing Bear is for giving Osage Nation Treasury money to benefit the Shareholders which may or may not increase headright payments.
Two things. One, this is the Osage People's money not Standing Bear's. Benefits to all of us come first before this very privileged class of Osages gets even more money from the Osage government including, two, the dead on smoking gun open verbal conflict of interest in stating that he wants to use government funds to raise his headright checks since he is an admitted headright owner along with his wife among other headright owners. Bullseye violation of Article X, Section 3 and Section 4 of the Osage Nation Constitution.
Benefits for us all in a per-capital payment or a Christmas Bonus or whatever else you can think of first Chief and then you and your shareholders in the OME can look at what's left, if anything at all, the way you spend money.

    1. WOW! I thought I heard him say he was there not as a part of the government? With a banner of the Osage Nation behind him and Clarion Call adverts for this meeting on the Osage Nation web site... He's so convoluted half the time, I wonder if he actually believes what he's putting out there to the public.

  64. William Fletcher mentioned in the joint meeting that the law suit is "complete" and now he's waiting for reply/results. This case is so important, it's directly related to the horror of our past. Thank you William Fletcher for your effort and devotion to follow this through, and those previously involved, God bless those who have passed. I've waited with great interest for this monumental moment no matter the ending results. Rosemary Wood's Osage News article was posted Jan. 10th, just two days before this news.

    1. What? So you get an accounting? None of your business who gets what, who got what or anything else in between. What happened to the right to privacy where personal property is concerned? Next, if it came from the Trust quarterly payments, will Billy Sam want an accounting of how you spent the money or if you even have spent it? So rank and low rent. As usual.

    3. What truth? That you got a headright check and how much you've made over the years for all the world to see? How exactly is this any of my business? BTW, Billy Sam should know that I, and a ton of others like me, really don't care. I don't even care whether or not the Headright owners are Osage or not. This is so juvenile and provincial to me it's not even to be believed. Even if you know, the Federal Court won't let you take my money away now or ever so what the hell is the point?

    4. This is how misinformed you are about your rights as a Headright owner you are. And some of us do care about the direction we ate going in. It should have never been allowed our Headrights to be given away in the first to an entity or non-osage ever. This occurred for many reasons if you understand our History. Not so complex. But I do care and you are only and probably the only person who does not care so why post here. This site is not for you then. Here is one of msny lessons you should take in Business 101 economics. Shareholders need financial statements to evaluate their equity investments and help them make informed decisions as to how to vote on corporate matters. When evaluating investments, shareholders are able to glean meaningful data found on financial statements. It allows you to study the over all performance.

    5. Nonsense! This was then and is today property owned by individual Osages who have every right under God to dispose of such property as they see fit and have seen fit for 110 years. You have no right to sit in judgement on how they have disposed of their own property no matter how selfish and greed driven you are. This is the proverbial "elephant in the living room" with the Osages and one of the reasons that headright owners today and yesterday have said to family members across the board, "You'll find out about the headright income when you get the check and not before." Mind your own business. Get your nose out of my families' business and every other shareholder's business as well. You don't have the right to determine whether or not it's right or wrong if headrights have been given away to anyone in the world or any entity whatsoever. Move on and concern yourself with your own business and not mine or anyone else's. Get on with your life and let others live theirs the way they choose and see fit to do so.

  65. Never mind the hotels/motels at the Casinos. If the Osages really wanted to do everyone a favor, they'd build a decent motel on Campus. They've got enough land there and money available surely to make that work.
